The rules of the game.

These terms are an agreement between you and Simulated Sphere Innovations Private Limited, the publisher of Quiz Ultimatum. By installing, accessing or playing the game, you agree to them and to our Privacy Policy. If you do not agree, please do not use the game.

Who can play

• The game is for players aged 13 and above. By using it, you confirm you meet this requirement.
• If you are under 18, or under the age of majority where you live, you confirm that a parent or guardian has agreed to these terms on your behalf.
• You may not use the game if the law of your country prohibits it.

Your account

• Guest accounts. You can play as a guest without an email address. Guest progress is tied to the device you play on. If you uninstall the game or lose the device, you may lose it. Link an email address or a Google account from Settings to keep your progress.
• Registered accounts. If you create an account with an email address or Google, you must give accurate information and keep your password secure. You are responsible for everything that happens on your account.
• One session at a time. Signing in on another device ends the session on the previous one.
• Usernames. You can change your username once every seven days. Usernames must not be offensive, hateful, sexual, impersonate someone else or infringe anyone's rights. We may change or remove a username that breaks these rules.

Please tell us straight away at support@simulatedsphere.com if you think someone else is using your account.

The game

• Quiz Ultimatum is free to play. Players answer timed questions alone or in rooms of up to 20 players. In multiplayer, the lowest scorer receives a dare chosen by a vote of the other players.
• Questions and dares are generated automatically by artificial intelligence. We work to keep them accurate and appropriate, but they may occasionally be wrong, unclear or unsuitable. Questions are for entertainment only and are not facts you should rely on.
• In multiplayer, our servers keep the clock, check answers and calculate scores. Their results are final.
• We may add, change or remove features, topics or modes, and the game may sometimes be unavailable for maintenance or reasons outside our control.

Dares

Dares are part of the fun, and you are always in control:

• Every dare is a suggestion, never an instruction. You are free to decline any dare, at any time, for any reason.
• Never do anything that is unsafe, illegal, harmful, harassing, or that involves another person who has not clearly agreed to it.
• You are solely responsible for anything you choose to do in response to a dare. We are not responsible for actions taken outside the game.
• If a dare ever seems inappropriate, please report it to support@simulatedsphere.com so we can improve the game.

Fair play and acceptable use

When using the game, you agree not to:

• cheat, including by modifying the game, reading or tampering with its network traffic to gain an advantage, or using bots, scripts or other automation;
• harass, threaten, bully or abuse other players;
• use offensive, hateful, sexual or unlawful content in usernames or quiz topics;
• interfere with the game, its servers or other players' experience, or try to overload or disrupt it;
• access or attempt to access accounts, systems or data you are not authorised to access;
• copy, reverse engineer, decompile or create derivative works of the game, except where the law expressly allows it; or
• use the game for any commercial purpose without our written permission.

Ads and purchases

• The game shows ads between matches, provided by Google AdMob. How ads use information is explained in our Privacy Policy.
• Where it is offered, the ad-free upgrade is a one-time in-app purchase that removes ads. It is tied to your Google Play or Apple App Store account and is non-transferable.
• Purchases are processed by Google Play or the Apple App Store under their own terms. Refunds are handled by the store according to its policies, except where the law requires otherwise.
• Prices are shown in the store before you buy, and may vary by region.
• If we ever stop offering the game permanently, we are not required to refund purchases, except where the law requires it.

Content and intellectual property

• The game, including its design, artwork, avatars, text, software and the “Quiz Ultimatum” name and logo, belongs to Simulated Sphere or its licensors and is protected by law.
• We give you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the game on devices you own or control, for your own non-commercial entertainment, in line with these terms and the rules of the store you downloaded it from.
• Your content. You keep ownership of what you put into the game, such as your username and the topics you type. You give us a worldwide, royalty-free licence to use, store and display that content only as needed to operate and improve the game, for example, to show your username to other players.

Privacy

Our Privacy Policy explains what information we collect and how we use it. You can ask us to delete your account and data at any time.

Suspension and termination

• You can stop using the game at any time and ask us to delete your account.
• We may suspend or close an account, or remove a username, if it breaks these terms, puts other players at risk, or if the law requires it. Where appropriate, we will tell you why.
• The sections on dares, intellectual property, disclaimer, limitation of liability, indemnity and governing law continue to apply after these terms end.

Changes to these terms

We may update these terms as the game changes. If a change is significant, we will tell you in the game before it takes effect. If you keep playing after it takes effect, you accept the updated terms.

Disclaimer

The game is provided “as is” and “as available”. To the fullest extent the law allows, we do not promise that it will be uninterrupted, error-free or free of harmful components, or that questions and dares will always be accurate or suitable. Nothing in these terms limits rights you have as a consumer that cannot be limited by law.

Limitation of liability

To the fullest extent the law allows, Simulated Sphere is not liable for indirect, incidental, special or consequential losses, or for loss of data, progress or profits, arising from your use of the game. Our total liability to you for any claim relating to the game is limited to the amount you paid us for it in the 12 months before the claim, or USD 50 if you paid nothing.

Some places do not allow these limits, so they may not apply to you. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

Indemnity

To the extent the law allows, you agree to cover any reasonable losses we suffer because you broke these terms or misused the game, including anything you do in response to a dare.

Third-party services

The game relies on third-party services such as Google AdMob, Google Sign-In and the app stores. Your use of those services is also governed by their own terms and policies, and we are not responsible for them.

Other terms

• If any part of these terms cannot be enforced, the rest remains in effect.
• If we do not enforce a right straight away, we have not given it up.
• You may not transfer your rights under these terms. We may transfer ours as part of a sale or reorganisation of the game.
• These terms, together with the Privacy Policy, are the whole agreement between you and us about the game.

Governing law

These terms are governed by the laws of India, and disputes will be handled by the courts of Madurai, Tamil Nadu. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring claims in its courts.

Apple App Store, additional terms

If you downloaded the game from the Apple App Store:

• These terms are between you and Simulated Sphere only, not Apple. Simulated Sphere, not Apple, is solely responsible for the game and its content.
• Your licence is limited to using the game on Apple-branded devices you own or control, as allowed by the App Store Usage Rules.
• Apple has no obligation to provide maintenance or support for the game.
• If the game fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation for the game.
• Simulated Sphere, not Apple, is responsible for addressing any claims relating to the game, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection claims.
• If anyone claims the game infringes their intellectual property rights, Simulated Sphere, not Apple, is responsible for dealing with that claim.
• You confirm that you are not located in a country subject to a US government embargo or designated as a “terrorist supporting” country, and that you are not on any US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
